Before commissioning a book project with Life Story Books, please read the terms and conditions as below.

Terms & Conditions

These terms and conditions apply to all users of this website. If you do not accept these terms then you should immediately stop using this website. your use of the website confirms your acceptance of these terms. We will not be liable to you for any interruption or delay that you experience in accessing the website, whatever the cause. Please ensure that you also read, understood and agreed to our Privacy Policy prior to using this site.

No metatags, hyperlinks or other forms of linkage whatsoever to any other website may be imposed on the website unless express prior permission has been given. Access to particular areas of the website may be subject to additional terms to which you confirm your acceptance of by entering the particular areas. If you do not accept those terms then you should immediately stop using those pages.

Life Story Books does not warrant that functions contained in the website content will be uninterrupted or error free, that defects will be corrected or that the Content or the Server(s) are available free of viruses or bugs.

This website is made available on the basis that there are excluded, to the extent permitted by law, any terms implied by statute or otherwise and all liability for any loss or damage however it arises out of the use of this website or reliance on its content.

Variation of these terms & conditions

We reserve the right to make changes to any part of the website. It may therefore be necessary to change these Terms and Conditions. If we do change the Terms and Conditions, we will update the date above. If you use any of the website after we have published such changes, you will be agreeing to be bound to those changes. If you do not agree to be bound by the changes then you should immediately stop using the website.

Definitions

“We” refers to Life Story Books, 33 Rosebery Avenue, Brighton BN2 6DE

“You” are the person purchasing or enquirying about the Goods and Services or the person visiting the website.

“Proposal” means the email confirmation of the offer of goods and services, along with the prive and payment terms.

“Book” or “Books” means the final output, whether printed or in electronic format that has been created by Life Story Books using the content provided by You.

“Content” means a Book or any text, photographs, illustrations, video, etc. supplied by the You or peoples requested by You

“Contract” means this legally-binding Terms & Conditions agreement between You and Us for the supply of the Goods and Services.

“Contributor” means a person that has contributed any content or has been interviewed as part of creating a Book.

“Delivery Location” means the location indicated by the Customer or StoryTeller where the Goods are to be supplied, as set out in the Order.

“Goods”, “Services” or “Goods & Services” means the goods and services advertised on the Website or agreed in written form that we supply to you of the number and description as set out in the Order.

“Order” means the Customer’s order for the Goods & Services from the Supplier as submitted following the step by step process set out on the Website; whether paid for online, by phone, bank transfer or otherwise.

General

By ordering any of the Goods & Services, you agree to be bound by these Terms & Conditions. You can only purchase the Goods and Services from us if You are eligible to enter into a contract and are at least 18 years of age.

Nothing in these Terms and Conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which the Supplier may be entitled in relation to the Goods and Services, by virtue of any statute, law or regulation.

Nothing in these Terms and Conditions shall affect the Customer’s statutory rights as a Consumer.

Commissioning and Payment

After initial correspondence, we will send You a Proposal outlining the services will provide along with payments schedule. In most cases this will be 50% paid on agreement of the proposal and 50% on production of the text of the book, supplied as a Word Document. 

For bespoke packages we may agree different payment terms in writing.

The price for the Goods and Services is as specified in the Proposal. There is no VAT charged on the Goods and Services

Payment of the price shall be in the manner specified in the Proposal.

Upgrades are invoiced immediately and need to be paid before we can proceed with the process.

Any invoice we send to you is due for payment within 7 days.

We reserve the right to suspend all work on your project if any payment is overdue.

The Process

We will arrange interviews with You either in person or by another agree medium, eg. Zoom or WhatsApp video.

We will ask you to supply the required images – either physical or digital.

We will take the utmost care with your photographs and will return them by an agreed delivery method. However, we do not accept liability for damage or loss to photographs supplied. Any photographs sent to Us are supplied solely at Your risk

After the completion of interviews, we will provide you with a text proof. We will incorporate any clearly articulated changes to the text you may request in your first draft in a round of revisions.

We will send a new proof with your changes. Once you have agreed the proof is acceptable, we will create a new proof as a PDF with images, captions and cover pages. At this stage, you will have another opportunity to proof the book. 

If you find any further factual errors or misspellings we will incorporate these as long as you indicate these to us before approving the proof for print.

Once these changes have been made, we will send a new proof for approval.

After approval, we will publish a full quality proof book. You will have the final opportunity to check for errors that have been missed. 

We will make the final amends and order as many books as agreed in the Proposal.

Please note that it is possible for errors to occur in any book. We will do our best to correct them all but can’t guarantee this.

If You require more changes or proofs above the opportunities listed above, there may be an agreed additional fee to cover the time it takes us.

Copyright & Confidentiality

The copyright of any Content is automatically passed on to You on completion and full payment.

You have the right to share the Book both electronically and in print, with friends, family members and colleagues. 

You are liable for any damages as a result of complaints made about the Content by third-parties including defamation charges.

Unless otherwise agreed in writing, Books are private and confidential.

Your Obligations 

Provide us with any information reasonably required to create the book

Obtain all necessary permissions, licenses and consents which may be required before the commencement of the services, the cost of which shall be the sole responsibility of the Customer; 

Comply with such other requirements as may be set out in the Proposal or otherwise agreed between the parties.

Our Obligations 

We warrant that the Goods will at the time of delivery correspond to the description given by the Supplier.

We shall perform the Services with reasonable skill and care and to a reasonable standard in accordance with recognised standards and codes of practice.

We accept all responsibility for the condition of tools and equipment used in the performance of the Services and shall ensure that any materials supplied shall be free of defects.

Cancellation Policy

Once we start work on the Book, the first 50% of the Book order is not refundable. Should You decide at the time of the second payment, that you do not wish to continue, we will cancel the order at that stage and waive the second payment. If you paid 100% at the start, we will reimburse 50% less any discounts offered for full advance payment.

Waivers and limits of liability

We not exclude liability for: (i) any fraudulent act or omission; or (ii) for death or personal injury caused by negligence or breach of the Supplier’s other legal obligations. Subject to this, the Supplier is not liable for (i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (eg loss of profit) to the Customer’s business, trade, craft or profession as the Supplier believes the Customer is not buying the Goods wholly or mainly for its business, trade, craft or profession.

We will not be liable for any loss of profits, economic loss, or indirect or consequential loss of any kind arising out of or in connection with the Project.

We aim to deliver your Book in the highest quality possible, we can’t guarantee a book without any errors.

You do not own the Book nor any copyright until we have received payment in full.

We will endeavour to complete the Book in timely fashion and within three months, but We shall incur no liability to the Customer in respect of any failure to complete the Services by any agreed completion date.

Governing Law

The Contract (including any non-contractual matters) is governed by the laws of England and Wales. Disputes can be submitted to the jurisdiction of the courts of England and Wales.
